The right of the people peaceably to assemble is one of the most important and least understood of our civil liberties. In the past decade, legal scholarship has renewed attention to this right, prompting broader cultural and judicial engagement with its scope and meaning. At the same time, our country has witnessed protests emerging in a variety of contexts. What are, and what should be, the contours of an assembly right that accounts for both the interests of the government in maintaining order and the interests of the people in disrupting order for the sake of change? And how do we understand this right in a society marked by rapid changes in demographics, technology, and other factors?
